Courtroom theatrics, fear, and faith over fear
Sammanfattning
A lively Friday at the Radio Ranch: after wrangling an echo and a few plumbing gremlins, I welcomed common-law scholar Brent Allen Winters to unpack a turbulent news week and the legal bedrock underneath it. We walked through the Minneapolis shooting discourse to focus on first principles—federal versus state authority, scope of duty, and why resisting officers in the moment can turn deadly—and then pivoted to foundational common-law ideas: trespass and burglary (with vivid hypotheticals), perjury as an oath-crime, strict liability for inherently dangerous things, and how modern “notice pleading” replaced old formulaic pleadings. Brent also traced the militia/jury twin duties in our constitutional tradition, the difference between “debt” (from contract) and “duty” (from law), and why courts must correct themselves when they err. We closed with his linguistic-legal dive on “Amen” as taking judicial notice—accepting what’s obvious—and a reminder to fear God rather than men.
